May Commercial Chapter 11 Filings Increase 62% Over Last Month
According to data provided by Epiq AACER, May 2025 saw U.S. commercial Chapter 11 bankruptcy filings rose 62% to 733 from 453 in April. Total commercial filings increased 8% to 2,695, while small business filings under subchapter V rose 3% to 228. Overall bankruptcy filings dropped 3% from April to 48,218, with noncommercial filings also down 3% to 45,523. Chapter 7 consumer filings declined 7%, while Chapter 13 rose 3%. Compared to May 2024, total bankruptcies were up 7%, with Chapter 7 filings rising 11% and Chapter 13 up 1%. Epiq AACER and ABI leaders cite high borrowing costs, inflation, and global instability as key drivers.
